There has been a growing amount of press coverage regarding the harmonised WHS legislation, its effectiveness, and the impost on business of compliance.
After a long process of consultation and review, the new model Work Health and Safety Act and Regulation are being released, and in some states have already been passed into law.
Safety management systems and procedures need to be brought into line with the new legislation, and given this is due to come into force in January 2012, there is not a lot of time left to prepare.
It will be important to ensure that your organisation’s systems have been checked for compliance with the key changes brought in by the Work Health and Safety Act in order to be ready before January 2012.
Critical areas that you must ensure your safety management arrangements address include:
- Duty of care obligations.
- Communication and consultation obligations.
- Definition of person in control of a business or undertaking.
- Definition of a “worker” and implications from this.
Officers within your organisation also need to be aware of and receive training in their obligations, as penalties are increasing.
